With effect 1st October 2011 amendments to the WA Workers Compensation Legislation came into effect.
Three changes are relevant to the day to day running of business:
Age-based limits on entitlements are now removed so a worker over 64 years of age will have the same entitlements as any other injured worker. This is not retroactive so the benefits will only apply to injured workers over 64 years from 1st October 2011
Employees must pay an injured worker their entitlement within 14 days of the insurers approving the claim. The fine for failure to do so is $2,000. This is very relevant if you pay salaries monthly.
The time frame to lodge a claim has increased from 3 to 5 working days. There is now a $1,000 penalty if a claim is not submitted within the five (5) working days from the injury occurring.
